KIRIBAKO Terms of Use
These Terms of Use ("Terms") govern your use of the mobile application "KIRIBAKO" ("the App") provided by Hiroyuki Hirata ("we", "us"). By using the App, you ("you") agree to these Terms.
1. Scope
- These Terms apply to all relations between you and us regarding use of the App.
- The App is distributed via the Apple App Store and is also subject to Apple's terms (e.g., Apple Media Services Terms and Conditions). Apple Inc. is the merchant of record for purchases and distribution.
2. Overview of the App
- The App lets you record and manage fishing catches (bitterling and small fish), perform semi-automatic body-length measurement using a reference object (a coin), and generate specimen-card-style images.
- The App processes data on-device. We do not collect or transmit your catch data, photos, or location (see the Privacy Policy).
3. Disclaimer Regarding Measurement Accuracy — IMPORTANT
- Body-length measurement in the App is an estimate based on the size of a reference object and its detection in the image. Errors occur due to camera angle, perspective distortion, reference-object detection accuracy, keypoint placement, and similar factors.
- Measurement results are for reference only. We make no warranty of accuracy or fitness for a particular purpose. Do not use them for official records, tournament records, regulatory size determinations, or any purpose requiring accuracy. Use a dedicated measuring instrument for accurate measurements.
4. Compliance with Laws; Protected Species
- You shall comply with all applicable laws and regulations concerning fishing and harvesting, fishing rights, fishing rules, and local ordinances.
- Certain bitterling and other species are designated as protected (e.g., under Japan's Act on Conservation of Endangered Species, natural monuments, or invasive-species regulations), and their capture, possession, or transport may be prohibited or restricted by law. You are responsible for verifying this and shall not capture protected species. The App does not encourage or promote the capture of any particular species.
5. In-App Purchases and Subscriptions
- The App offers the following paid features (App Store pricing prevails):
- Kura: one-time, non-consumable purchase for permanent access to recording features.
- Takumi: auto-renewable monthly subscription for the recording features.
- Takumi renews automatically unless canceled at least 24 hours before the end of the period. You can manage or cancel via your App Store account settings.
- Charges are billed to your App Store account. Refunds follow Apple's policies.
- Price changes, free trials, and migration offers follow Apple's mechanisms and our notices.
6. Prohibited Conduct
You shall not, in using the App: violate laws, infringe third-party rights, reverse-engineer, misuse or modify the App, or act to the detriment of us or third parties.
7. Intellectual Property
Copyright and other intellectual property rights in the App and related content belong to us or the rightful owners. Catch data and photos you record belong to you.
8. Disclaimer; Limitation of Liability
- We do not warrant that the App is fit for any particular purpose, accurate, or free from interruption or error. The App is provided "as is".
- Except in cases of our willful misconduct or gross negligence, we are not liable for any damages arising from use or inability to use the App.
- Where applicable law does not allow exclusion of liability, our liability is limited to the minimum extent permitted by law.
9. Privacy
Handling of personal data is governed by our Privacy Policy.
10. Changes to These Terms
We may amend these Terms as needed. Material changes will be announced in the App or on our website. Continued use after changes constitutes acceptance.
11. Governing Law; Jurisdiction
These Terms are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
